    Hi
    I am currently constructing duplex in Toowoomba. The builder is claiming that construction has reached fixing stage. Suddenly got legal notice from subcontractor’s lawyer advising that the Builder has not paid for the work completed by his client company. Being an owner I have to stop the payment and asked builder to sort out the issue. Very next day I am getting another mail from building certifier company advising withdrawal of certifications in regards to the work they have done as they did not get paid as well.
    I have paid all the invoices raised by the builder up to the enclosed stage. It is clear to me that builder is having serious cash flow problems.
    My concern is what should I do with this situation where builder is only contactable through the developer as part of the contract. Also how can I make sure that I will have quality product at the end of the construction.

    Thanks for the reply. Would please recommend good solicitor as all of this is first time for me so not sure where to look for?

    Hi JJ

    You really should have entered into a purchase or a construction without a solicitor going into bat for you. First thing tomorrow morning, get yourself a solicitor that is solid in the field of representing clients that are engaged in construction projects.
