All Topics / Help Needed! / Tenants refuse to leave
Hi guys I know I don’t post often but read a lot. This topic has probally been covered and I apologise if so but I need some advice on tenants not leaving our house.
We have a house in Brisbane which desperately needs renovating. We have givin tenants 2 mths notice (through realestate) have also told them not to worry to much about cleaning the place as it won’t matter to much to us. They are also behind in rent and realestate has a court day next week to have them removed. Today I called as we would like to fly up from Canberra to assess the house before going up with tools. We were told we can’t go there and must give them notice. Now being behind in rent and past the date of being out I find this unbelievable.
Now I have heard of reports of tenants having more rights then the owners and also of horror stories, I guess it just hits home a bit more. It’s only early days still but we have hit panic mode.
Does anyone have a clearer picture of landlords rights for us? Any words of advice would be appreciated
Yes you will need their permission as they have possession of the property. Check out the residential tenancy act.
