Hello Forum,
I currently have a property under contract in SA.
The building inspection has determined that there is no RCD, and the smoke detector is non-compliant (9V battery style).
The property is currently tenanted, but I am pushing for vacant occupation. The tenant has been there for around 5 months.
I have been led to believe that there was a legal requirement to have these two items addressed prior to obtaining a tenant.
Is the vendor responsible for fixing these items prior to settlement, due to their existing legal requirement, or is it a case of caveat emptor, and I have to wrangle an agreement as a change to the contract?

Not sure about the RCD but in NSW (at least) the smokey is an essential (it is nominated in the contract of sale) – so confirm with your solicitor.

I have had some great advice from a buyers agent a few months ago. "if you allow to spend at least 2 to 3 grand to repair or fix whatever to bring a IP up to your standard, then when you only have to spend a few hundred you have had a good day"
I would just smile and organize to have it sorted once you have taken over.
