    Hi all,

    I am an Australian citizen currently working in Shanghai, China. I have just been approved by AMP Bank to refinance my existing IPs in QLD, VIC and to acquire a new property in NSW. As part of signing the loan and mortgage documents, it requires a JP or Legal Practitioner to witness my signature? If I were to get an English speaking lawyer who is licensed in China to witness the documents, is that okay? I am flying back to Hong Kong this weekend so if HK licensed lawyer to witness as well? Your help is much appreciated.

    Hi John

    Different lenders have different requirements.  The safest way is to find out from your lender who they will accept as an approved Witness.  As you know, they are lending the money and they make the rules in this respect, e.g. if the need the docs to be witnessed by a Victorian or NSW registered lawyer, then that's what you'll need to do.

    Their legal dept sets the requirements and trying to move a lender's legal dept is like trying to move a mountain  ;-)

    Or find a Notary Public.  Internationally accepted witness.

    Yeah, just a local lawyer probably wouldn't cut it. Australian consulate would be the way to go.

    Go visit your local hotel foyer in HK, you're bound to find an Aussie solicitor on holiday. Had it have been earlier in the week, you may have got Julia to oblige as she was doing the rounds of China. (Possibly try the Oz consulate as well).
