Hi all,
Recently, I request 2 contracts for sale from 2 different properties.
Why does one contract include sewer and easement diagram but the other one does not have ?
the properties are in Sydney NSW.
Does this mean, in NSW, a vendor does not have an obligation to obtain or disclose a sewer/easement diagram in 149 certificate for the sale of a property ?

If you check out the Conveyancing (Sale of Land) Regulation 2010 – Schedule 1 you'll see that the drainage diagram is a prescribed document, i.e. it has to be attached. You can view this requirement at: http://www.austlii.edu.au/au/legis/nsw/consol_reg/colr2010311/sch1.html (point 2).
