All Topics / Help Needed! / urgent need help with a in connection with getting money out of a owner who is not paying his body corporte fees!!
Hi There
I stay in complex of 6 units, where we are having a problem with one of the owners not paying his levies.(the owner is renting it out) The owner is outstanding from last year November2010. We as a body corporate have taken him to VCAt with not much success. Are there any other ways we as a bodycorporate could get this money out of him to pay for his levies. we had to have a special levy to pay his fees as he was also from the previous year in debt not paying his levies.
Please I need some advice!!!!!
What does the strata managers have to say about it?
If you don't use one, it might be time to consider it. Otherwise, you may need to seek legal advice or read the strata act for your state.

Hi Gert
What exactly did VCat say, and how long ago was the case heard ??
Although i am not based in Vic, VCat is the governing body that oversees body corperate / strata issues…
You can appeal a VCat decision to the Supreme Court of Victoria, but i would have thought that something as simple as an order to pay outstanding levies would be a fairly strait forward order made by the tribunal member on the day.
