    Advice wanted.

    I live in a flat as an owner occupier and I would like to create a private courtyard out of the strip of common property/land that runs between my ground floor flat and the side fence. Mine is the only balcony that faces the fence and no one uses the area, it’s just dead space really and perfect for a wee garden, one end is fenced at the front already. How would I go about gaining permission to fence this bit off and use it privately.

    You couldn't own it but if you wrote a letter to the body corp and presented your wishes at the AGM those in attendance could vote on it.

    Seek a special resolution & get exclusive use of the area. Similar to how some parking spaces/garages are attached to units.
