All Topics / General Property / Renting a property to yourself???
Hi,
I was just wondering if under the whole trust/company structure described by Steve whether it is legal to buy a property under a trust entity and then live in the property as a tenant, effectively paying your rent into the trust?
(…a bit of a weird one i know…).Thanks for your help
Hi – I was of the impression only commercial property could be purchased with super?
1 – the trust is a separate entity to yourself. There is nothing stopping you leasing a property from a different entity however you cannot rent from yourself, so a trust with a corporate trustee can lease to you as a person without any issues.
2 – Maree, no-one mentioned the word 'super' but a smsf can purchase any type of property however restrictions apply to purchasing residential property from a related party.Yes it is possible to rent from your own trust
