We are just starting out on this whole development thing and are knocking down our home to rebuild and then sell. We have struggled with finance and although I thought our lender new that we had to demolish the existing house they didnt want to pay for it and we were stuck with a demo bill and no way to pay it. I understand that we stuffed around with the demolishers but would like advice on one aspect of the bill. (I thought this was all handled 2 months ago but when I sent them a large amount of money).
The quote came in at 11500 + gst (it is finishing at 20500). We had to add some for asbestos and the removal of services and fence hire so the bill increased. We also paid interest on the amount outstanding. All OK. Now the problem, they added $2500 for additional weight. They knew that we were not happy with that amount because we think that when they quoted on the house they saw the "size" of it and that they should have been able to get their quote correct.
In the end I decided to split the difference and paid half of that amount……….Is that reasonable………..now they want more and are threatening legal action and debt collectors. HELPI don't think that is reasonable at all. I haven't seen his quote, but I wouldn't be paying anything for additional weight,unless they had specified in their quote or conditions that they had allowed only for a certain weight. Even then I wouldn't pay until he provided proof from the weigh bridge of the weights, and I checked that the paper work actually related to my job. I wouldn't just believe everything they say.

They're the experts, they provided a quote based upon an inspection. Unless the demolisher had provided an exclusion eg asbestos, detailed the extent of the work (eg demolition of house, footings, grub out services etc) or quoted the weight that they had allowed for, </////////] them! The Dept of Fair Trading will come down on your side. Security of payment legislation (NSW) does not apply to contracts between Home Owners & Contractors only between head contractor & subbies.

I dont think this is fair.
Unless his specified in the original quote that he has not allowed for removal of services then I wouldnt be happy with that. I also don't think its fair to add on temporary fencing because this should have been apart of the original quote unless specified that it is not. The asbestos is something that you should have to pay extra money for.
I'm also with tools, unless the original quote was subject to weight then I wouldnt pay anything. What did he think he was moving?!!

p.s
I'm in victoria an unless rules change in different states asbestos must be disposed of by a registered remover properly. Maybe this is something you can have on your side if the demolisher has not disposed of it correctly.
