my dad left me a property and he was 51% owner of the property my uncle and aunt each own 24% of the property now i am interested in subdividing but i need to know if i could just sell my half without subdivision and do i have more control over the property then my relatives for they are trying to squeeze me out and take my property from me i really dont want to go into the details but i would really like to know what my rights are here. thanx for ur input it is greatly appreciated
Are you joint tenants or tenants in common? Joint tenants means that there is a right of survivorship and the property cannot be transferred to other parties whereas tenants in common means that you could sell your share to another person (and the last one standing does not get the property).
The main issue with subdivision is 'what half is yours?' – you own a non-descript portion of the whole (just like owning shares – you cannot identify particular assets which belong to you in BHP).
