I own a unit that is one of four under a strata plan in Victoria.
I have just realised that the exterior of the building has been painted without my knowledge.
The property is only 4 years old, so painting was not due to maintenance needed. Someone has decided they didn't like the lovely timber facade and painted it a horrible yellow!
What are my rights? Can I make them change it back? Nothing has been noted in Body Corporate meeting minutes or expenditure reports, so I am pretty sure another owner (who owns 2 of the remaining 3 units) has taken it upon themselves to change the appearance of the building.
Any advice much appreciated.
Such a capital expenditure would have had to come from the Sinking Fund of the Body Corporate and would have required a motion at the AGM or an EGM where all of the unit holders would have the opportunity to vote on.
If this has not happened I would ring the Body Corporate and find out under whose instructions are they acting.
If it was not authorised by the majority of the voting members you would have the right to have it changed back to its original state. Liability would lie with the BCM.
