Recent developments in the law relating to family discretionary trusts and in
particular the Federal Court decision late last year in the Richstar case have
raised issues as to whether assets in some family trusts may be exposed.
For example, there may be circumstances where the bankruptcy of the person
controlling the trust may prompt a trustee in bankrputcy or another aggrieved
person to seek access to the trust’s assets.
Further, many family trusts may not adequately address issues of succession
planning, for example, in situations where those persons who control the
trust die without leaving another party in the proper position to control the
trust.
There are also a myriad of tax and accounting issues that arise through the
use of trusts. There are some important traps and planning points that need
to be kept in mind so as to avoid unintended tax liabilities and consequences.

these and other issues associated with family trusts both from a legal and
accounting perspective.
