Hi all,
Just want to check with the experts – we are in Victoria and a real estate agent told my husband that WE have to get the Section 32 done ourselves. For some reason I thought the R.E agent did this. My hubby checked with a few people and it seems that yes we have to do it. So why have a real estate agent? I can get the S32 done no problems- so basically all the R.E. agent is good for is having a database of people ready (supposedly) to buy.
We have had our place listed on the internet (to sell ourselves without agents) but are now tossing up putting it with an agent…so basically all they did (which I knew they would) was put an extra $10k on the asking price (which I doubt we will get anyway) and we still have to pay for the S32!!! This doesn’t happen (or didn’t- in Tassie).
We want to get this property sold- do we soldier on with selling it ourselves (we have had interest but not enough to result in a sale) or put it with the agent. (either way I have to do the Section 32)…
We are meant to be meeting with the R.E agent Tuesday to sign paperwork.

You must be quite offey with the search process but what about people who have no idea how to do them? Like pensioners who don’t even have access to the internet.
That is very bizzare to me, you are doing the agents job!!!!
Now as you said, the agent’s job is just to find the purchaser, would you still need to pay for advertising?
If so, why not just do it yourself????

THe section 32 is basically a vendor statement , as in something you as the vendor have to supply in order to make your house available for sale, so so have to organise or pay someone else to do so for you as you suggested. If you have had some interest in your house already, you could certainly do worse than try and sell privately. We sold our last PPOR privately, and th e interest we had was far more than what the real estate agent could drum up by sticking one add in the paper, a sign in his window, and being bored when showing someone through our home. I made up a webpage, and did a couple of private paper adds and made up a sign and I was away. Nothing a good agent could not and should have done. And took a bit of pride in it when showing someone through……..A good and entusiastic agent though is worth their weight in gold. All the best with however you go about it.
Thanks people- now I find out we are also meant to prepare something else. Anyway we have cancelled the meeting with them for the time being. May list with another site online and perhaps yet a sign. I just dont know.

Your S32 and other docs (eg. for auction purposes) should be prepared by your Conveyancer, or if you choose to do it yourself, use a Conveyancing kit.As a Victorian, it’s a system that i am used to. When I sell my property, I go to the Conveyancer to organise all the legal stuff, and to the REA to find the purchasers. Sounds like different rules apply to different states.
Good luck with your sale, I agree with v8ghia. A great REA is worth the commission. However, i know they are few and far between.
