Unauthorised use of Common Property

Hi,
I was wondering the best way I should approach the dilema I am in.

I recently purchased an office which has air conditioning. Since purchasing I found out there has been a legal battle going on between the previous owner and the body corporate for some time.

One of the items is that the air con in my office was installed on the common property without the BC approval.

This office was purchased in Melbourne and the S32 did not note any such issue. The vendor would have been aware as this battle has been going on between them and the BC for over 12 months.

I plan to contact the BC and see if I can be granted permission. However I am guessing if it was that simple, then it would have been done.

So in the event that I dont get approval, what options do I have?

Any suggestions are greatly appreciated.
