    I am building an IP in the northern suburbs of Perth. The builder has advised me they have struck limestone so there could be further considerable expense involved with site costs. The only problem is the limestone is part of a limestone retaining wall that was constructed by the developer. I have contacted the developer who says the builder should have been clearly aware where the limestone retaining walls are as they are clearly shown on council plans. The builder is saying because of where I wanted the house placed on the block this is why this problem has occured. Shouldn’t the builder advise me if the placement of the house is inapropriate when we are at the planning stage?. I would appreciate feedback of what action people on this forum would take from here.

    At first I was thinking “Great…start a quarry, theres dollars in limestone blocks….’

    I have built a few in Perth with spec builders.
    The worse one I had was where the builder did the siteworks and laid the slab, then discovered that the sewer line was to the front of the block and that it was uphill!
    They suggested I needed to install a pump, etc to make the sewer system work….
    Bottom line is that they redid the siteworks ( filled the block )and redid the slab…at their expense.
    I wonder how many places have a double slab ( extra one as a foundation?)

    As the builder is responsible for site works, I would agree with you that they should have advised if the placement of the house was inappropriate for the block.

    In terms of action, I would handball it back to them….get them to fix it at their expense.

    Sounds like it could get messy though….

    like the name so i will put on the hat.
    Its all in the contract that was signed as a rule rock,stone or alike is not usually cover in the contract unless specified I spend upwards of 30k a year on geo reports for this reason.
    If the developer has told you about this limestone and has a geo report then I would be asking my very friendly legal eagle( and they are very friendly if you mention money)to have a chat.
    if there is no geo report and lot don’t you can say all you like the builder will say I didn’t no and its not his job to do geo reports and then you may have an unhappy little eagle.
    and which ever way it goes the eagles are going to get involved so consult them first
