    Hello All,

    Just wondering if anyone could give me an example of a written offer and the types of clauses that you may include to safeguard oneself.

    Any suggestions would be great!

    Josh,

    A basic example could be:

    OFFER TO PURCHASE REAL ESTATE

    Purchaser’s Details: Name, Address, Phone

    Property Details: Address of Property

    Offer Amount: $150,000

    Terms: Deposit of $3,000 + balance in 120 days

    Subject to:
    a/ solicitor reviewing the contract to the purcahser’s satisfaction
    b/ finance approved in 14 days
    c/ builder’s report to the purchaser’s satisfaction

    Offer Expiration: Close of business Friday 3rd March

    Signed Your Name

    Make sure it is in writing, that way you look like you know what you are doing and there will be no confusion.

    Hi Josh

    Be a bit careful because anything not specific could come back and bite you. Petes suggestion of having it subject to a solicitor reviewing is right on track that wat you can get out. A lot of contracts now have cooling off periods as well.

    In Qld to be a valid deal it MUST be in writing if it relates to real estate. Not sure where you are but it is probably the same

    Thanks guys for your help!!!!

    I’ve heard people adding clauses such as “subject to approval from partner” or “subject to finding finance suitable to the purchaser”.

    Are these usually enough to get you out of any problematic situations?

    Hi Josh,

    When I purchased the property I currently live in, which is a duplex half, we had a clause that stated we’d like to meet the neighbours and reserved the right to cancel the offer if we didn’t like them! I was surprised the Real Estate agent even let us get away with that one! We just wanted a way to get out of the deal if we needed to. (The neighbours are great by the way!)
