Hi all, a mate recently offered to sell me his house for a set sum and even tho’ i expressed enthusiasm he then listed with an agent for 10k more. If he decides to sell to me does he have to use the agentand if not how do wego about conveyecy etc

Yukko, i hate vendors like that. If he has an exclusive contract with an agent to sell his place now he has to pay them a commission even if he sells it himself during the usual 2 months of his contract with them. If it is an open listing, only if he sells it through that agent does he pay them. So go get that house before the agent stuffs the deal.

I was in the same boat as you (see. BUYING THE HOUSE NEXT DOOR). My neighbour approached me, and then signed up with an agent only hours after telling me!!!!
As mentioned, if he has given agent exclusive rights, it may be tricky, and he will have to wait till that contract lapses. If he hasn’t, he can still sell it to you without having to pay agent.
As for selling without agent involvement, you can take the matter straight to your solicitor or conveyancer to prepare documents/contracts (i.e. Section 27 & 32) and settle the matter.
