    Hi,

    Experienced negotiator guidance needed.

    I found a motivated seller. At the moment she just signed up with the real estate but she was willing to deal with me privately. Recently the agent has put up “For Sale ” sign but has not advertise in the paper yet which was suppose to be done this weekend.

    How hard is it for her to break the contract and does it involve any fees at all???

    Secondly. My stuffed up which I hope which can be admended but some guidance will be appreciated. This is my first contact with unwanted and I got too carried away. Anyway, what happened was that she was interested to sell to me but after chatting to her, I think she lost intererested. I was throwing seller finance and everything which was taught by Robert Allen to her which I think has frightened her a little bit. Maybe more than a little bit. Just through body language and not returning my calls afterward, my impression is that I think she think that I am trying to reap her off. Should I continuing to pursue it or just leave it and hopefully she call me back. I want to act fast so she can break the contract with the agent before they proceed further with the advertising.

    Any advices will be appreciated.

    Hi Cris,
    I think for starters if I understood correctly that you have an agreement with the agent and this lady has signed a contract then you can not break your agreement with the estate agent. Further more i do not think she can get out of the contract either.
    The agent could take you both to task.
    As far as the hard sell goes put yourself in her place if you came on to strongly and she is not aware of the concept you probably scared her off. I reckon you should now wait on her reply.

    Hi Chris, my understanding is that you are the buyer and now you have to deal with an agent. Just put your plan forward to the agent who must show it to the seller. Secondly drop a copy off into the sellers letter box. Wait 1 day and then contact the agent to ask what the seller thought of your proposal. Then check with the seller and confirm what the agent said. If the information is different ask why. If the seller wants to sell she will let you know, otherwise move on to something else, and then check again in 1 week. Keep doing this until it’s sold if you really want to buy this property. It is important that you do this in a professional manner, so it’s not seen as harassment.

    I think given that the lady has removed herself from further discussions with you, you might need to let this one go. Whilst RE agents are expensive and some of them can be dodgy, I suppose (although my dealings with agents have been good thus far), they provide protection from potential buyers. She has employed the RE agent to negotiate on her behalf, and you need to respect that.

    Go to the private sites on the net, or check out the newspapers to see who’s selling privately. She’s paid a RE agent so she doesn’t get ripped off, and she’s paid the RE to get her the best price. Other more savvy buyers will sell privately and probably have significantly more negotiation skills than your lady might have. Please don’t encourage her to break the contract she has entered into.

    Platypus, remember that Robert Allen also often says ‘A confused mind says no’. In this instance I would suggest that this is what has possibly happened.

    Once you have signed that agreement with the Agent, you can’t get out of it unless they agree to let you go.
