Just wondering if someone could shed some light on which states the and/or nominee clause is allowed?
Cheers

Hi Pete,
I believe that in Vic the and/or nominee clause is still allowed IF you have prior written agreement with the other party (the and/or nominee part). I’d be interested to see if this is different to what I thought.

NSW is no go.
I beleive what Sooshie says in regard to Vic is correct, but have heard this has changed recently.
I haven’t tried it in NSW, but one of my clients was advised by a solicitor that it would be ok if the nominee was your trust/company or a relative.
