What is the date of the finance clause? If it has expired and you did not notify the other party, then it is no longer a condition and you are locked in and you are in a very dangerous situation.

You are very brave in not chasing up the broker to find out where your loan was, especially if you were supposed to settle so soon. I think the broker may have been slow, but broker's do not guarantee loan approval and therefore I am not sure if you have any grounds to complain. You need to keep on top of these things.

Also factor in the amount of interest you are saving by not having the loan drawn down yet.

The date in finance clause was expired weeks ago, spoke to vendor and realtor for an extention, however, they verbally agreed it and never put it on paper.
Apparently, me and the realtor was chasing him everyday since 3 weeks ago and he was kinda useless.

Sounds like the loan isn't even approved yet, if they are asking for more things and you are waiting for the letter of offer. I would be more worried about losing your 10% deposit and being sued. Have you been issued with a notice to complete yet?

The loan has been unconditionally approved on Friday. Now I'm waiting to sign the paper. I signed the contract subject to finance, so I rekon it should not be a issue.

No, I didn't receive a notice to complete yet, the other conveycer just called my conveycer regarding to the penalty charge on 1st July.

It was the broker's assistant admint it's their faulty by losing my file. Now the broker completely denied it when my Conveycer spoke to him on last friday.

Other than that i think you would be lucky for Homestar to have the loan approved by 26th July let alone June.

Unfortunately I've missed my settlement day due to turn around time of Bank. Well, seems some one finally looking at my application asked more information and I send it to them straight away. Hopefully, I've get the loan approval by the end of this week.

The original rent was $30pw under the majority as my one is on the first floor.  It has been open mid week and on weekends with several groups going through on each occasion.  We have lowered the rent and are currently asking $70pw under our original price.

You mean $300, right??? Can not be that cheap

My loan still not going anywhere. I believe it's something to do with CGT. well, the critical date should be contract of sale rather than settlement day.
Seeing others got their loan in 3 weeks made me think I made a bad choice of getting loan from Homestar…

    Hi Yiima,

In the current climate it is important to allow for the delays that the lenders are causing when signing a contract.  Prior to signing you should have all your information ready for finance and set a longer settlement date.

I guess, all these are too late. Fingers crossed

Well, I'm currently applying my home loan from Homestar. Their variable interest rate is very attractive compare to local banks.

I'm getting very frustrated at the moment. 2 weeks later, I'm not even getting an conditional offer. It's not like what they promised on the website, get loan in 5 days. You gotta be joking. Now my settlement is at the end of the month, and the broker was telling me that they struggling to meet the settlement date!!!! He even send a email to my realtor asking for 2weeks extention without telling me. Informed me last Wednesday that my application is at valuation stage. No valuer showed up until today……

I'm really pissed off and it's kinda late to turn around to get another broker. So furustrated to explode!
