your business name could be the trustee company or trust or any other business trading name.

My business trades under the same name as my trustee co. so thats the name I use on my cards.

I think there are faults in both the Jenman system and the conventional system and it’s different for each property. The law can be interpreted in many different ways and it’s never really an issue unless someone refuses to pay or finds you accountable for something, then the law gets looked at.

Sounds like a great project. However, I would be looking to minimise risk as much as possible. Try:

Make sure the agency agreement is cancelled in writing!

Check the agreement to make sure that the agent has no recourse at a later date for claiming full commissions for not selling the property. If he is a fool he is likley to act like one!
