    Isn’t it wonderful to see people going to the trouble of preserving these homes, even though the costs are a bit wacko i truley commend all of you who do this, good stuff guys and gals

    Richard is correct however I believe that the valuers do have a bias between local and interstate buyers and nothing is going to change.

    DQ is only one operator of over pricing. He keeps escaping because he hides behind bank valuations, and when in court no judge can prosecute him because of this.

    Just how much is the true value of a property is the question, to me all the products come from the same place so why such a variance is beyond me. I pay $750.00 per/m2 including land scaping and turn key, so a 20 s/q house is $150,000.00 complete with air and all the bells and wistles.

    If you r paying more than that you have rocks in your head, I know some builders are charging $195,000.00 for what i can do for $150,000.00 go figure. But let me say some thing before you shoot me down ALL THE PRODUCTS COME FROM THE SAME PLACE.

    There r 2 secrets to building

    1. the land price

    2. the construction price

    both of these will give a wholsale price and then go do what you want. So back to the valuations QV’s r running scared for the reason what Richard said and any body stupid enough to pay toooooo much and get caught, read the contract CAVEAT EMPTOR

    Do you own the site GrossR – Southport is a very clicky area with lots of development approvals out of council and put on hold because of the market down turn in this area.

    I spend 3 days every two weeks in this area so i know it well. You can buy a 3 bed unit in Main beach for 325k and walk to the shops, which is a better buy than Southport at present. Behind the Grand you can buy a 4 bed waterfront home for 1.2mill which i think is cheap compared to Sydney prices.

    My wife and i are seriously looking at relocating the family to this area before the kids go to high school. You can get a lot for 2mill around this area, you can also loose your shirt if you really don’t know the locals and the local market.

    We also put a Medical Imaging centre together in nerang st GR so i do know this area – lots of retirees and older population – do your research to what THE MARKET WANTS IS THE SECRET OF PROP DEVELOPING.

    Hi again Tony, yes we/i have taken on many cases but mainly on getting the development approval granted either from the council concent or neighbours, but never to sue for an easement.

    I agree when all else fails sue the whole lot – when doing that and in your case i would consider suing the council and when you WIN you can get costs awarded.

    A council cannot grant an approval with out providing solutions to the easement issue or another alternative to complete the approval.

    If ONE neighbour is the issue then that may be the easiest solution but can you get the costs back? If these costs can be absorbed into the development then so be it. Your solicator who you know for many years – what is their advise?

    Think out side the square of using a trust when developing for CGT and other ATO issues.

    Wow what happens if the LAW says that all wrap deals are retospective … i would c..p myself … any way when you front the judge the truth will come forward …

    Hi mate – good one, not. Wow what a doozy you have, i would suggest a personal letter to the owner explaining the situation and your intention to settle out of court.

    Some times we get into the habbit of letting our solicators guide us when in fact a cold bear and a t-bone steak may be the fix.

    I personally would not like an easement but I am sure that everything is negotiable … keep us posted please and good luck.

    Hi Kenkok 2000 and thans for a great response – I only have one problem with some of your comments;

    1. Try standing in front of a Judge and saying that.

    2. Clarifying details will prevent disputes and is propper business practice. You should see the contract I am involved with in a Mirvac deal.

    3. Unsophisticated investors have been ripped off in the past because of unclarity and get out clauses.

    4. There is a litinany of people who have been screwed, go search the ACCC – ASIC – FIDO and other sites.

    5. Your item 7 is so far out it is unreal in terms of legal sence.

    6. As far as doing things the Orintial way I agree and I personally have done a great deal with Japan, Korea, Taiwan etc and believe me they are thorough in every sence of the word, especially dealing with westeners.

    So in summary i would love to a deal on a hand shake but as i get older and wiser the more detail protects me/my family/and my partners from any possible disputes and conflicts.

    Hi Simon (about time) welcome to my world. I love duplexes and currently hold 7 (14) in QLD out of the projects i have been involved in. 5 are in my superfund (long term hold strategy) and the other two have borrowings on them.

    Yes the numbers work as long as you pay the right money for the land and construction cost. You can check out Westminister Homes and Champion Homes both in NSW who build up there. Both these companies r very cost effective.

    I also provide quality inclusions. So i use a cost effective (project home builder) and then trick them up with;

    20mm granite top in the kitchen
    Air conditioning
    6 x ceiling fans
    Dish washer
    Stainless steel appliances
    walk in robe to main
    built in robes to all rooms
    2 car remote garage
    floor to ceiling tiles in ensuite and main
    3 x toilets
    tile all common areas
    carpet in bedrooms only

    By proiding more quality i achieve two things

    1. greater tax deductions
    2. higher rent and ROI

    How long is a piece of string, try going to the local council web site for info.

    Also try going to some planners in the area or the yellow pages etc, where is your site that you want info on, can you give us some clarity or are u just wanting general info.

    No i havn’t and i am glad i am not the neighbour. My question is why the council never allowed for this or did they in their overall development plan. In the case that is was allocated for future use then the neighbour doesn’t have a leg to stand on.

    Is it because of the new storm water and detention regs as i have been hit with $50,000.00 extra on a new house i have in the final stages.

    having an easement through a property will devalue the nieghbours property, is there any compensation your are bound to give, good case though and an interesting post … good luck, and your neighbour too.

    Thanks Dazz and for your comments. The reason i was invited in is because i have content that they require in the form of 115 modules and books on a variety of wealth topics.(property, finance, fin planning, accounting etc)

    Although their interest in a womens arena they are also providing assistance in other formats as well. Having one arena suits one area of the population but there are others who want to play it differently.

    Another very important area is wealth for teens and educating young people topics about wealth creation not taught at school. (saving, spending habits, property, leases, etc etc)

    Its not all about property as well its about planning – how to get started – death/divorse/disaster and other outside influences that get in the way of life.
