hey guys, I totally agree about there should be no nastiness or rudeness… but there is, and it’s coming out in all the posts.
I’m thinking that if people just HAVE to be nasty or to get something off their chest, go elsewhere…. set up a corner where they can play imature kiddies and leave others to talk descently to each other.

I agree with Dav… unless you’re working near Collingwood Park, i would think that it’s a bit too far out. There’s always good value within the inner city suburbs..
It’s not a bad area, quite a few ‘new’ estates out there, but just the distance would be a concern.
Depends on where you’re working though Jem… can you fill us in on that one?

Yeh, I think that only a limited number of the ones that you’re missing are printed.

DON”T SIGN anything until you have read absolutely everything… ESPECIALLY if it isn’t you that has done the offer up.
Really, they shouldn’t be doing that, it’s your territory…. that’s for you to be putting in what you want. You need to be putting in the offer of what it is that YOU think the property is worth, not what they would like in the bank from it.
I seem to remember one of Steves books saying that it’s either
1. Your terms and the asking price, or
2. Your price and a shorter settlement.have you negotiated any price or have you agreed to their asking price? if so, tell them that you will pay the price only for a longer settlement… 60 or 90 days. if they don’t like it, they can lump it. if no one else is willing to pay that, they’ll hunt you back down later to see if you’re still interested!
Dan, take control of this situation back, as you may regret it later and they certainly won’t have your best interests at heart… they just want to sell it … and NOW. Would hate to see you regretting going through with the decision.

I agree.. just give them the required 60 days notice (inform the agent that they must do this as that’s what they’re paid for!) and get them out if you want them out. Honestly, some other person will feel sorry for them and allow them to get behind in rent and be slobs.
Perhaps they will pull their finger out and take responsibility for themselves.
Oh yeh, and don’t bother finding out any more info than you have to… emotions are getting in the way of a purely business decision.

Not quite sure about the acceptance bit, but you can be assured that the money is held in a trust account.
Real estates must bank all monies received into their trust accounts within 24 hours… perhaps this is what has happened through reception or something?
Don’t worry, you will certainly get your money back if there’s a problem or the offer is not accepted. every last cent!

That’s really bizzare then Shaun… I would seriously be questioning the Property Manager in that case. They’ve made a decision to agree to that for the tenant without consulting the owner.. and in most cases, the owner is spoken to before the agreement is signed up?
To include an ‘option’ like that on a tenancy agreement is really unusual. Having written up hundreds of tenancy agreements (in a past life), I had NEVER come across that.
The only situation would be if the tenant has already completed a term through a lease. When is had expired, and the owner knows that the tenants are behaving, the owner may want the tenant there forever and will give the go ahead for the option to be included on the next lease. But never on the first one.
Bit weird that one… let us know what happens when you get back from seeing your friend Shaun. I’m very curious! [biggrin]

as for an option, it must be a qld thing.
It’s not a ‘QLD’ thing… this must be agreed to with the landlord and tenant anywhere.. not just in this state.
Wasn’t the owner asked if this was ok at the beginning of the lease when they were being signed up?

I think that may be a little harsh perhaps?
We all are in a position where we would never ‘trade’ our partner in for a new and younger model just because they don’t share our passion for investing! All of us that have replied throughout this thread have the same traits in common… we are committed and loyal partners who respect our differences with the other person and are willing to take the good with the not-so-good.
We don’t just dump them and get another that thinks exactly as we do.. how boring. That’s half the fun of it… finding out new things about your partner all the time.
Do you think that if the shoe was on the other foot, and your partner felt that YOU weren’t committed to something that they felt passionate about that they should trade you in? You probably wouldn’t be happy about that I presume?
I’m sorry for you if you seriously think that way, and hope that your outlook will change… as ‘trading’ partners because they don’t follow you like a shadow in your thoughts in every way can lead to a lonely life later.

Hi Shaun,
Is the ‘Option’ that the tenant is referring to in writing somewhere? is it on the original lease agreement?
If you ask me, as long as she was aware of the property for sale (she was given or sent written notice by the PM) and the lease only has 12 months for the original time frame, then she’s got buckleys. Sounds like she’s trouble, but I would think that she would lose money trying to push that one. Silly bugger!

Just wondering how long the PM was holding your rent for? was she holding it aside for you later, or using it for maintenance?
Did they not get a quote for the painting before it got started… if you were leaving it up to the PM to organise, they’ll pretty much go with the first one. Obviously not what you want!
I’m just curious as to how she was holding your rent? are they using a trust account? you would presume that they’re doing and End of Month procedure and you would have AT LEAST been paid within the month!
