    Who pays ongoing energy bills to run the pumps?
    Who pays for the pumping station inspections,  maintenance and replacements?

    Elderly tend to retreat to a safe place rather than understanding, so they usually have an advisor
    and that's the person you need to talk to. It may be a family member or old friend or solicitor,
    sometimes an old retired bank manager, but there's nearly always someone.  And she needs
    to know who is going to protect her and property – e.g Council, solicitor, friend etc.
    A stormwater pipe (through an easement) directly connected to the areas stormwater system 
    sounds much simpler and more sustainable into the future than pumping stations. 
    My suggestion is to fully explore both paths. 
    And in my experience of trying to deal with Councils, I'd prefer to deal with the neighbour.

    Hi Leharna
    The law covering the actions of PMs sounds unbelievably toothless in Victoria.
    I'm in NSW, and here it's got teeth.
    Just for the information of us Forumites, can you please tell us :

    The source of your first paragraph about the law ?
    Which Govt Dept licences PMs in Vic ?
    Under what Act are PMs licenced ?

    Sorry you had such a low yield outcome, it sucks cleaning up and fixing up after scum trash n run, not to mention the loss of well-deserved income, interest, time etc. and aggravation to selves and jobs. Hope it's your first and last, ever.

    Sounds like the BC's fault, since you don't organise the workmen's schedule.
    The body corporate should have given you the property owner as well as the resident tenant any available information about the proposed works, and if it was BC work, then BC should clean up too. 
    The tenant should have been advised about the work schedule in case it caused any inconvenience.
    Too hard to fit workmen into vampire hours so I'd say bad luck for the tenant's lost sleep.
    Too late for you to avoid the problem and the tenant didn't give you any opportunity to mitigate any loss and made no attempt to let you know ahead of time to mitigate the loss either, bad luck for the tenant there.
    I'd be inclined to send the tenant a couple of movie tickets bought on your credit card so you have proof, and an apology.
    Vampire tenant is unlikely to spend all day sleep time  waiting around in a Tribunal for a doubtful outcome.
    Tenant might be due some compensation, but most likely from the BC, not you.

    Future residential tenants may be driven out by commercial development around them.
    When I picture a house between factories or warehouses, I only see problem tenants.
    Land should appreciate, could be a site to place a commercial building in the future.

    Good question.
    Other factors affect the price over 5 years, like
    proximity to infrastructure like freeway, hospital, shops, school,
    local employment
    land size
    supply & demand of housing in that area
    Not easy to compare these 2 , because there are pluses and minuses,
    the house has one more brm, more land and probably on ground level, while
    the townhouse probably has less land, maybe 2 levels, but proximity to beach & city.
    My money's on the house due to bigger land and more bedrooms.

    Number8 just renewed my faith in the finance industry – where was this kind of direct help  when I was fresh out of high school?

    The Law Society can give you names of specialists in certain areas. Few lawyers like the Residential Tenancies Act area because it pays poorly and usually involves tenants with no recoverable assets, however in your situation, it may be a Real Estate Agent as the target.

    Dept Fair Trading in each state should be able to advise you how to proceed through them to ask DFT to address the problem against the REA whom they have licensed, and who have legal obligations and penalties under the Stock & Station Agents Act.
    DFT are powerful if they decide to act, and can summon all docs from the REA to assess their actions under the act, and audit their agency and trust accounts while they're at it.

    Depends on all the fine relevant details in these things and the laws of the state you're in, the devil's in the details.

    Not sure if it's the same in every state though. You would most likely need to pay whatever it takes to fix the property immediately to mitigate losses, get it rented again, then you have a clear figure of your losses in $$'s, and can claim, but talk to your insurance company first so you can proceed under their instructions with insurance cover still in place.
    I sympathise with your anger n frustration at what sounds like a negligent PM.

    Hi Richard n Banker
    OOOOhh  goody, is this an option to those conservative valuers so favoured by the big 4 ?

    Coz I'm in the process of discussing this problem with St George, where I want to buy residential property, then mortgage it to release funds to buy a commercial property (motel), which then gets me a commercial loan at res rates BTW.
    But, the point is, bank valuers are conservative ( unless they want to get struck off the bank list of favoured valuers), so for example, if I buy a res property for $500K cash, val is 90%, then bank will lend 80% of val, I've lost at least 30% of the borrowing capacity of my $500K cash through banks allowing themselves big security buffers at my expense.  

    Anyone got any ideas ?
    Maybe I should make this a new post instead of digressing off someone else's post, sorry Qld .

    That vacant property could've been yours next tenant changeover, (may you never have one).
    When I was a PM, I always worked Saturdays, because that's when the gainfully employed can do inspections.

    How long do you want to live there?
    How long do you think they will want you to live there?
    How long do you think they want to live with you?
    What is your exit strategy ?
    How can you teach them to fish rather than giving them fish ?
    Do they want to be self sufficient, and can you help them achieve it ?

    Maybe Rudd or his shot dog could create a new bunch of jobs called insulation quality control inspectors to check the batts in your belfry, but start with you know who.
