    I am willing to pass on their details, but am unable to find their card at present. Will ask around, please email me if I forget to get back to you.

    From memory, the solicitor is located in Melbourne and they charge around $1000 to remove defaults etc. This is not so high when you consider the potential reduction in interest rates acheived when the clients are able to get into nromal loans.

    Usually they get their solicitor to put one on, but they could do so themselves. I was charged about $60 once to put a caveat on a property, so it is not so expensive.

    I think you can get margin loans to buy shares etc and pre pay the interest. Have a look at etrade.

    Also have a look at those capital guarranteed share schemes which enable you to borrow 100% of the share value without the risk of the values going down. These have rates of around 15% so should give you a nice deduction. Comsec, ANZ and Macquarie offer them.

    Options fees are often 1 to 2% of value, but you can negotiate whatever you can. But the agent won’t be happy as Rob mentioned. Maybe you could promise to pay him extra now and then again on settlement.

    I don’t know about that? I think it dpends how frequetly you buy and sell. I don’t think a trust has anything to do with it as my trust has had to pay CGT – sorry, i meant distribute capital gains.

    Another strategy. Macquarie Bank, ANZ and CBA all offer some sort of capital guarranteed share investments. They work with the bank lending you up to 100% (I think) of the share value, you hold the shares for a fixed period, and then you can ‘give back’ any that have dropped in value for the same amount they cost you. The rates are high – like 15%, but getting a large portfolio and prepaying the interest will dramatically decrease your annual income and hence CGT bill. You just have to work out if the shares are likely to increase enough in value to make it worthwhile.

    hi there.
    Rob, I know of a team of solicitors that sepcialising in removing entries from CRAA files – legally of course. They use some small mistake or technicality of the lister and threaten to sue them if they do not remove the entry. it seems to work with judgements and defaults.

    Liz, I had an application of mine initially reject by westpac based soley on the length of my file (not trying to boast here!). But they passed it when explained.

    The company must pay tax on its profit, so taking the money out won’t cost you anymore in tax unless you are on a higher bracket than 30% (franked dividends).

    I would be using a trust to invest in property myself, rather than the company. And using a trust, you may not have to pay any CGT, however if you do, you have more flexibility in reducing the amount.

    If you structure you purchases correctly now, it maybe possible to transfer you property to a smsf without incurring stamp duty. If you need to – that is.

    This sounds like a reasonable figure. using a mixture of business, shares and property a 10% return is not very high.

    eg. Imagine if you used this money as deposits for wraps. $20,000 deposits on 15 properties returning $3000 pa each after costs = $45,000 plus all the capital gains on cashout.

    There is a really good book which I bought years ago. But I have jsut lent it to a client and forget the title. It was something like
    “How to pay your mortgage off years sooner..”
    the author was from WA from memory.

    Hopefully your rents will service most, if not all, of your loan repayments.

    I think DD has it down pat. If you are planning on buying and selling, then just using a LOC secured on another property may also be an option as it reduces costs.

    I beleive that is correct. You, or the trustee, can distribute as you see fit – any percentage you like. So if you have some bennies give them as much as they can handle, then the rest could be diverted into a company.

    Supa Freak. You technically are giving them the money, but they may give it back to you. Usually it is just a paper entry, and you may give them a bit for their troubles. bear in they they have to include this money in their tax return and may have to pay tax on it.

    btw, I am not an accountant, so this may be wrong.

    I have heard Roy say that too. He also said the legal fees involved would be an amount similar to the stamp duty anyway.

    Cnetrelink make it hard on pensioners. If your mum rents out her current home, the rent may result in her losing pension or having it reduced. Why don’t you ring them up and explain the situation and see what they suggest. They have financial planners/advisors there that can help you. War pensions may be different too.
