Tenants in common means that the portion that you own will be part of your estate, and therefore can be given in your will to anybody of your choosing. If there is no will, then yes logically the spouse and/or the kids will get it.
Leo, that’s true. You don’t get the ‘threshold’ that individuals do, but I still think that that is a small cost to pay for the flexibility of distribution of the profits, and asset protection.

I did not say you must have a ‘lack of money’. No money would seriously dent how you can live, but the pursuit of money should not be what life is all about. In the end, it’s not going to make us happy. However, if we are unhappy, at least we will be comfortable []
Come on guys, I think it’s safe to say that it is an old riddle, and very American based. Depending on what part of the country they were in, we know they did some bloody awful things to the blacks.
Now let’s assume the homeowner called the exterminator company. He would not have known necessarily that they were going to send a black fellow would he? So suffice to say that when not wearing clothes of any kind, we leave them hanging in the wardrobe – do we not? Even ‘ceremonial clothing’.
We also don’t know what ‘did’ happen after he saw the outfit, but put yourself in a black man’s shoes (in KKK territory), and what do you think when you see the outfit in the closet. I disagree with BlackJack in that the clothes being in the closet meant the guy was ‘changing his ways’. If he were doing that, he would have destroyed the outfit altogether.
Aussie, no one told me. I was just talking to a friend last night, and asked him if he’d ever heard the riddle before. He hadn’t, and then it hit me, and I said that he was black and it was a KKK outfit. My friend said ‘You didn’t tell me he was black!’. That’s cos I didn’t realise it until that moment.

Rachel, what James said is spot on. there are many interstate people that use Dale Gatherum Goss who is in Melbourne. Same same Bruce Whiting in Sydney. Nick Moustacas is also in Sydney.
Search for accountants, and check out the Somersoft forum – Dale GG is a moderator there, and I’ve actually seen him recommend some accountants in people’s areas. I personally don’t know how he has the time to do all he does!![]
Redwing, for a trust being set up with friends rather than family, I would definitely go the Unit Trust structure. This way there is a fixed entitlement for all, whereas with the Discretionary or Hybrid Discretionary (which can be done!) the trustee has discretion.
The Units in my Unit trust with the other people will be owned by my family trust, so I can still split the portion that is mine between family members as best fits.
Chan, I think you would want to keep your ‘uniqueness’. You don’t actually lose it by copying someone’s ideas to make money. Money isn’t all there is to life. If we were all the same it would be pretty boring.
