    Not necessarily Derek.

    Tenants in common means that the portion that you own will be part of your estate, and therefore can be given in your will to anybody of your choosing. If there is no will, then yes logically the spouse and/or the kids will get it.

    Leo, that’s true. You don’t get the ‘threshold’ that individuals do, but I still think that that is a small cost to pay for the flexibility of distribution of the profits, and asset protection.

    James, you ‘may’ be able to do it if you initially set the trust up with yourself as trustee. As trustee the properties are in your name anyway.

    Definitely ask the solicitor – I’m not sure if they have to do anything special in the contract etc. to show that it’s being bought ‘as trustee for’.

    They sound like serviced apartments. These units would have very high costs, low LVRs from banks, and low CG.

    I did not say you must have a ‘lack of money’. No money would seriously dent how you can live, but the pursuit of money should not be what life is all about. In the end, it’s not going to make us happy. However, if we are unhappy, at least we will be comfortable [:)]

    Rachel, what James said is spot on. there are many interstate people that use Dale Gatherum Goss who is in Melbourne. Same same Bruce Whiting in Sydney. Nick Moustacas is also in Sydney.

    Redwing, for a trust being set up with friends rather than family, I would definitely go the Unit Trust structure. This way there is a fixed entitlement for all, whereas with the Discretionary or Hybrid Discretionary (which can be done!) the trustee has discretion.

    Chan, I think you would want to keep your ‘uniqueness’. You don’t actually lose it by copying someone’s ideas to make money. Money isn’t all there is to life. If we were all the same it would be pretty boring.
