    That's an awful situation.  What state are you in?  it might be worth looking at what your local real estate institute offers on this.  they'll have information on dispute resolution for sure.

    It's hard to see how they should be allowed to keep it when it's clearly an error (do they acknowledge it's an error). 

    Perhaps it could also be considered as criminal theft or some type of fraud if they don't give it back.  I know when malfunctioning ATM's spit out more money than it's meant to there can be criminal repercussions if the money is not handed back.

    I'm surprised they even have that power.  I've always thought of strata rules with things like all owners must keep their homes painted in the best mission brown, can't do certain reno's etc.

    What else can you stick into a by law?

    Thanks for your insight Derek.

    It seems strange that teachers can choose not to do something that is so valuable for children by taking them out of the school as part of their education.  Perhaps that should be a formal part of their role.  Having said that it sure is crazy to hamstring teachers with over burdensome red tape and put them in such a position that it makes it almost impossible to do it.  But why should that stop creativity within the fences.  For example, why not have financial studies/Accounting students run stock take of the school canteen or help run the second hand uniform shop.  Food Tech students supply the snacks/sandwiches for school board meetings.  You have to work in a team, work to a deadline, do things you don't like, work with people you don't like etc.  I believe there's things that you can do to engage students within the curriculum in ways that will introduce them to new life skills that won't compromise their learning.  Hey, I'm rambling too!

    WOW, nice comments and reply.  This area of social life always fascinates me.  My gut reaction would be it's the parents role to teach life skills and values, and it's parents who need to be educated about imparting these skills if you are to educate anyone.  Schools exist to support the family and provide the more academic and decreasingly available practical aspects of life (think Technical Schools, VCAL etc) that will prepare them for further study or entry to the workforce. Now before I get beat up for focussing on the three r's I realise school and teaching doesn't exist in a social vacuum but that's what the curriculum should be addressing. 

    I don't think that precludes 'life skills' being introduced and taught effectively through the school system (as a support to the parents role) but I don't think much of it should be part of the curriculum.  Instead, why can't life skills be taught through how the curriculum is taught.  Think well thought out incursions and excursions, camps, and class projects that require students to learn and develop life skills on the way to meeting academic and technical skills type outcomes.  Why can't more innovative ways to teach 'life skills' co-exist with ensuring kids are well drilled in their rrr's in a classroom?  I just don't think 'educational programmes' are the way ahead.  The less the state formally intervenes in the social aspects of raising a child the better I think.

    I'm inspired by people facing adversity who push to overcome no matter what confronts them.  For me the endurance and resilience of the human spirit is something spectacular to see.  It always involves courage and determination and that really speaks to me.

    Hi Jamie,

    How do you feel about the proposed borker practicing certificate outlined in the article?  There doesn't seem to be any criticism of the level of broker training.  I can't see how another course would improve a person's attention to detail (which seems to be the complaint).  Do you think it would make any difference?

    That's great stuff Ziv.  It's easy to take for granted what we have and be ignorant to the plight of others,  If people took time to consider those less fortunate and give a little bit of support back to others we could make massive differences to people lives who really need it.  But it is important to do DD on the organisations you support to make sure your money is getting through and not just getting eaten up by admin and marketing costs.

    I don't know enough about the way new homes are sold to draw conclusions but is it the profits or transparency that people are objecting to. Everthing from lettuce to motor vehicles gets marked up from cost price and wholesale price for the public.  Why not with property?

    I came across this story recently:

    An economics professor at a local college made a statement that he had never failed a single student before, but had recently failed an entire class. That class had insisted that socialism worked and that no one would be poor and no one would be rich, a great equalizer.

    The professor then said, "OK, we will have an experiment in this class on a socialist plan". All grades will be averaged and everyone will receive the same grade so no one will fail and no one will receive an A…. (substituting grades for dollars – something closer to home and more readily understood by all).

    After the first test, the grades were averaged and everyone got a B. The students who studied hard were upset and the students who studied little were happy. As the second test rolled around, the students who studied little had studied even less and the ones who studied hard decided they wanted a free ride too so they studied little.

    The second test average was a D! No one was happy.

    When the 3rd test rolled around, the average was an F.

    As the tests proceeded, the scores never increased as bickering, blame and name-calling all resulted in hard feelings and no one would study for the benefit of anyone else.

    To their great surprise, ALL FAILED and the professor told them that socialism would also ultimately fail because when the reward is great, the effort to succeed is great, but when government takes all the reward away, no one will try or want to succeed.

    In most cases vacant posession will give you more options,  Home buyers are more likely to be put off if they have to settle on a tenanted property.  Investors can go either way but it would depend on the quality of the tenants.  I suppose it depends on who you are pitching the sale to.

    I've never really followed fixed rates because I like the flexibility of variable rates.  General question, are they as sensitive to movements by the RBA as standard variable rates?  FWIW inflation is lower than expected and the budget isn't overly expansionary so I don't see any immediate pressure on the RBA to raise interest rates.

    Are you able to add value to your IP to create equity?  Quite a few forumites do this to help them leverage into more properties.
