    Danielle, this information may or may not be true. In any case I fail to see what relation between naming and shaming someone publicly on a forum and what the legal situation of a court case against a 19year old boy has to do with anything.

    Brian I know a few Vendor Financiers that are successfully doing deals in SA.

    These investors are doing these deals live both locally or remotely.

    It shouldnt be a problem to develop on the land as long as you ensure that all the points / clauses that you agree upon are in the special conditions of the option.

    for example: based on what you have mentioned above, clauses that you and the vendor may negotiate are:

    1. Buyer is granted the authority to develop the land without exercising the option

    2. Should the buyer choose to develop the land after approved DA application has been submitted a license to occupy (develop) fee will be paid to the vendor for ($x amount)

        in addition to the option fee payable.

    3. Buyer is required to obtain the appropriate insurances required to develop the property

    4. etc etc etc

    I know a great legal guy that does both residential and commercial who is all over these types of contracts.

    Letters that are too neat and lack a touch of personality are what is used by Real Estate Agents – its one of their marketing and prospecting strategies. I have found that this is very informal and wreaks of marketing all over it.

    If you have written a letter the the vendor and they contact you great…. theres two answers that they will give you, call my agent or lets talk.

    Having said that when you are talking to the vendor find out why they are selling and chat about their situation. That way you can both put your heads together and get a deal happening. From ther its pretty straight forward to send it to a legal guy to prepare the paperwork. If  your doing something creative then check out this website: http://www.vendorfinacelawyer.com.au they have a whole bunch of information and legal contacts that can prepare the bespoke paperwork in your state.

    I used to use a spreadsheet now and found a great program called "Vendor Finance Calculator" – it has recently been updated to a new name and contains a CRM and also will help you produce your annual reporting and give you all sorts of data regardless of the the investment strategy your using.
