    Welcome to the forum.

    Most zonings in Queensland are regulated by the council in which the property stands. You can fins some of these details at the individual council web sites but generally you are better off contacting that council for the specific location.

    If you looking at a particular development-ASK if its okay and then get it in writing

    Hi Kerri

    I had a look at Jacobs Well about 12 months ago when they were starting to do some work. Some of it didn’t look too bad but I thought property prices were up there then. What are they like nopw??

    The other problem with JW is getting there. It’s a fair trip from the M1 to JW thru a lot of farming contry. I wonder if this will slow the development? I suppose 20 years ago they said the same thing about Sanctuary Cove!!

    Hi Brian-and welcome

    Dazzling is pretty much on the mark. A lease is only as good as the tenant so it wouldn’t hurt to find out how long he has been there and if there have been any problems during that time (eg arrears of rent). If things are sweet and he has been in occupancy for a while, hopefully things will stay good. If there are problems and he doesn’t pay (and then refuses to go) you may find yourself up for more money to try and kick him out. Hope that isn’t the case hear.

    Also remember the other side of the coin with tenants under a lease, if he complies with the terms of the lease you MUST keep him on as a tenant at the agreed rental. You can’t even try and remove him if you get a better offer (or for any other reason) because he has a right to be there. If he exercises his options to extend (and there has been no defaults) you are obliged to extend in accordance with the options.

    Good tenants are great-bad tenants are a great pain in the….

    Hi Paul

    I am on the coast too and it is interesting to watch the ever changing skyline.

    Your friend’s but may not be too bad but it is on the main road (noisy) and that might limit holiday renatls when times are slow.The body corp is also a bit steep so it makes it hard to earn a dollar even with a rent guarantee. Mind you most body corps are over the top at the moment.

    I’d suggest that she follow up on the tenancy position well and truly before the agreement expires. Most will tell you that holiday accomodation is risky as far as having concrete returns are concerned so she needs to keep her finger on the pulse.

    As for the Gold Coast market…got a crystal ball?it will be about as accurate as what any agent or property guru tells you. But good property will always be good here-just don’t let the hype suck you in!!-do your homework

    Hi Crashy

    I’d suggest that you make sure that it’s not a council water supply issue first (yellow water doesn’t sound like it is). But call you council anyway, make a complaint they will probably send someone out and if they say it’s a health issue, they can be the ones to make the owner fix the problems so you are not perceived as a whinging tenant.

    Then do as Aussierogue suggests if that doesn’t work.

    Hi Summer

    Sure there are cases where the debtor has no money and seems hopeless but we usually carry out an enforcement hearing. It orders them to appear in court (or they are arrested) and produce bank statements, tax returns etc for 2 years. We usually find a source to garnishee. Sometimes the sheer embarressment is enough to get them to sort it out before they go to courtIf the debt warrants it (and they own real estate) register a warrant and threaten to sell the property. Works wonders!

    Hi Yack

    I know we have discussed most of this but as far as their credit records are concerned, the court actually lodges the judgment details with Baycorp. Check with the actual Mags court where you regsitered your judgment and make sure they have notified Baycorp. That should carry on.

    If one of them is a physiotherapist then the state branch of the medical body may have a record of him if you want to locate him.

    Judgments do work. We get calls regularly from people who have a judgment we lodged years ago looking for their release.

    Time will be your friend (if nothing else works). Even if it is removed from their CRAA after 5 years, the judgment is enforceable (in most states) for 12 years. That’s a bloody long time to hold out.

    The easiest way is to ring the agent who sold it. If they think you are interested in similar properties, they will tell you the sale price of that one. “Iv’e been looking around Holland Park and liked a house at Stonyfell Crt. Do you have any similar in the same price range? What did Stonyfell Crt sell for?

    There are government based facilities but it depends on how recent the sale was as to whether its details have been uploaded.

    I guess there is always someone who will have a problem with regular finance but I agree that with the saturated broker market and every financial instition under the sun trying to lend money, there are not as many wrap deals around.

    As a sideline I use lo doc for my dealings but haven’t been able to get above 80% LVR. Who is doing 90%? (so I can kick my brokers butt.)

    Hi DavidM

    IUt shouldn’t negate anything but you will need to make sure that there is some documentary proof as to the 99/1 set up.

    Probably a greater concern is that if it isn’t your intention that the other party receive the full property entitilement in the event of your death (which is the effect of joint tenancy) it should be held in the required propotion (ie 99/1) as tenants in common in the appropriate proportions. Regardless of either of your wills, the property will automatically pass to the surviving joint tenant in the event of either one of you dying.

    Suggest you contact a solicitor to get the conveyancer to pay for the rectification if you can’t get them to sort it out.

    Just on the issue of trusts, does the actual distribution to the beneficiaries take place (eg you sell a property owned by a trust and make a profit of $20000.00, are you required to distribute to say four beneficairies @ $5000.00 ea for the purpose of the trust). I assume the beneficiaries then have to declare the income annually on their tax return??

    I also assume that apart from the legal protection a trust may give, if the property owners are low income earners then there isn’t a great advantage in having the trust anyway?

    And finally for those of you who use a trust as an investment vehicle, who do you name as beneficiaries. I assume your partner or spouse is one of the few but in light of the tax implications for children, there wouldn’t appear to be a lot of advantage in making them beneficiaries.

    Any thoughts greatly appreciated

    The cheapest (but not necessarily the best) is a real estate agent particularly if they think you are going to list your property with them. If you want it in writing, some will charge a small fee. But ALWAYS get several opinions if you choose an agent. They can vary considerably. It’s value is what someone will pay for it and some agents will try and “buy” your listing by over inflating the value.

    Check around and see what other sililar properies have sold for recently in the area and have a look in RE agents windows first.

    If you really want a proper Val, there are plenty of reputable valuers in Brisbane but they will usually give a lower price than an agent will and “valuations” will vary from “sale prices: as a rule.
