    tks. the interesting words there are ‘as a result of the introduction’. again im not sure how binding this document is and i reckon there are a hundred loopholes you cld find to get out of it.

    you cld feasibly buy a property ‘despite the introduction’ rather than buying a property as a ‘result’ of an introduction if you know what i mean.

    even though im a novice can u not negotiate the terms of this document?? maybe we shld all start adding clauses stating that if the house is not sold within the period with wch the agent has rights to market the property, then the agent has no claim on commission’ or words to that effect.

    might be hard to pass but in jenmans own words – you shld conmtrol the process and not the agent.

    tks wayne – i didnt know that! the was it works in the trading i do is that circumstances can change in 2 weeks and in fact this might be seen as a new negotitation. so how long can an agent have right to a property then – forever? in the above mentioned scenario cld the 2 parties wait a year and then get together or will the agent still have a case??

    you can insure aginst anything these days. alot are scams but at the end of the day its all a question of ‘risk’. the world is a riskier place these days. globalsiation, terrorism, etc mean that the stakes are quite high – so i reckon it depends on your personal position and exposure to risk whether it be finance, health or anything else.

    the industry preys on insecurities and will remind you constantly about the bad things that can happen to you.

    the best hedge against losing your lot is to ‘have nothing to lose’ or atleast very little to lose. if i save money, and dont be such a rampant consumer then im halfway there.

    i reckon the agent has no leg to stand on. why else do you think agents get you to sign a contract stating they have rights on the house for a certain period of time. if the house is sold within that period of time then they shld get the sale. if the time has expired then they shouldnt. its simple – why else have a time bar on the agent contract. if the agent can prove however that the parties deliberatley waited until the time bar had elapsed and then continued on with the sale privatley then they have a case….then the parties wld be profiting by deception.

    g’day – i wldnt fall for the line attach a cheque to show the vendor you are serious. why wouldnt you be serious. plus its a buyers market. agents suggest this in order to get you locked into the sale both financially and emotionally. i reckon only attach a cheque if you are trying to get the house cheap or if its a sellers market.

    by the way dont fall for the we require 500 to process your offer line. you dont need to give the agent anythign

    my thoughts anyway.

    i reckon we should all be careful not to push our middle class asperations on to our children. this discussion is primarily about achieving through property some kind of financial security. the truth is to a certain extent its all a bit of a myth.

    again must say kay has hit it on your head. you can avoid sibling rivalry and all the messy stuff by creating a household where this kind off stuff aint that important. like kay i grew up in a house where this kind of jealousy resentment thing was not ignored but was always put into perspective by my parents.

    teach yr kids to enjoy the things in life that dont involve money. teach them that the struggle is part of the fun, help them out if you want to, and dont if you think they are taking advantage…

    i like aceys idea about charging board then giving it back with interest.

    marc – im sorry i got no ideas whats best for yr family. reckon yr ideas are all valid…go for it.

    we haqvent had a good crash discussion for a while. if it crashes it will be a problem for many people. imagine paying of a loan that is more than than the price of your asset. and if the market stays dull for years (see singapore, hong kong, japan etc ), poeple need cash to survibe, you cld see a huge credit strain, the banks will start to bleed and we could have ourselves a fully fledged depression.

    then again it might not!!!

    peaople have made alot of money at the expense of others in the current cycle (see first home owners) so i dont see a crash as preying on others misfortune. we all owe it to ourselves to understand that a crash cld happen and take the necessary action to limit the damage.

    so if your top heavy on property sell some of it, buy some shares or some gold and leave some cash in the bank i reckon.

    acey i read your thread and your last comments on that thread. have you ever thought of investing in productive assets rather than just property?? this creates more than just personal wealth but also jobs and contributes more to the economy!! maybe you already do but i wld have thought the guy has a point. millions of property millionaires around the world is not a good thing ecause it doesnt help create greater wealth for the community as a whole…

    the word ‘ignorant’ as u used it was unfortunate as the correct term to use is ‘ignoramus’. which just confirms your point!!

    i think your example lacks a bit of ‘humanity’ in my opinion.

    but again these are only opinions – but a kind word or a kind deed done without judgement can speak 1000 times louder.
