A water authority plans to register a large easement (200m2) across the rear of my property (700m2).
I had intended to demolish an existing shed/garage and rebuild in a slightly different location in the back yard. If I am able to get the building permit approved before the easement is registered. Is the permit still valid?, even if the shed wasn’t actually built yet when the easement is registered.
Effectively I would be building a shed over the easement at the time of construction.
A build over easement permit is unlikely to be approved in this case.
