    Hey guys

    I live in a share house in Perth, and unfortunately have to break the lease due to friends falling out and no one wants to stay in the house. We have just signed another 12 month Lease. The Property manager says, we have to cover rent until a new tenant is found, is this right? Obviously we will try and help the landlords out as much as possible, but where is the line drawn? Is it one month like our bond?

    We also need to stay on good terms with the property manager as will be using them as references but what if we can't find anyone to move in? Do we pay 2 lots on rent?

    Any advice would be greatly appreciated!

    You are liable for the rent until the lease expires (so 12 months). The RE agent should advertise for a new tenant (at the same rent) and you pay until the new tenant moves in. They can also charge you advertising and change over costs.

    Check the WA Consumer Affairs website. It should have advice on what your rights and obligations are under the new form of lease (is it an REIWA lease or the new type lease?).

    Technically, you will be obliged to pay the rent until a new tenant is found unless there is a break clause in the lease. You will need to pay the owners costs in respect of advertising, lease preparation, reference checks etc.
