If a couple has a pre nup and then partner who owns an investment property gifts half share to the other partner. So both partners are on the title joint owners and both on the mortgage. Does this alter the pre nup as they are now joint owners. If it doesn't alter prenup  then does that other partner have a right to claim back funds paid towards that investment property.

IP is in victoria and no it's not hypothetical

    Thanks

If certainly would affect things. You are making a gift. Gifts are not returnable.
