    I have 2 adjoining residence in box hill. The rental property has half the back yard separated by a fence. My residence has access to this half of a back yard. How hard would it be to build a granny flat there for my own use?

    Would it be legal if I move into the granny flat and rent my principlal residence?

    I would love to give some feed back on this one but it's out of my experience, but there have been previous posts on granny flats which you could do a search for.

    Otherwise, I hope someone can give you a response.

    Hi Sinders,

    Your best bet here would be to call up council and see what their thoughts are on granny flats. They will ask for a site survey (if you're happy to go ahead with the project) and also some designs for the granny flat before giving approval. 

    This will ensure that they are satisfied that the development won't be a hindrance on the neighbors.

    Hi Sinders,

    A granny flat is so called as it is considered to be temporary accommodation for someone who is dependent on the occupants of the main home.  In many areas of Victoria, including in residential areas in Melbourne a granny flat is allowed without a planning permit.  However the catch is that it is supposed to be temporary and used as accommodation for a dependent person.  Anything else is just a house and if you put more than one house on a block you need to apply for a planning permit.

    Legally you'd have no problem in building a granny flat in the back of the existing property. There are some pre-requisites that the property must meet; see here for a granny flat approval guide:

    That information isn’t applicable to Victoria, you need a planning permit except for in the circumstances I mentioned previously.
