So I found a supplier through gumtree who had a renovation business closing down and was clearing stock…
I decided to purchase from him:
bathroom vanity
mirrored bathroom cabinet
shower screen
jarrah floorboards
wall exhaust fan
wall tiles
mixer taphe agreed to supply towel rail, shower head + tapware for free
He calculated the amount of wall tiles I needed based on my measurements, and the final price for the above was $2700. I paid $2000 deposit and agreed to pay the balance on completion when all goods collected.
He was also going to arrange a number of tradies, but this did not happen.
Long story short, and many times he cut me off on the phone, didn’t meet as arranged etc, I cancelled the floors, the shower screen he supplied was incorrect and not what was requested, and the exhaust fan unsuitable and not what was requested, and never got the free inclusions. Also I only required 25sqm wall tiles, yet despite 3 requests he never told me how much he had calculated but I believe it was in the vicinity of 55sqm.
So at the moment, I have collected goods worth $1325 which I am keeping. There’s a $50 exhaust I wish to return as its not what I requested, but its a minor thing. I asked him over the phone if he can sell the jarrah floorboards to someone else or needs me to still take them, didn’t reply.
He agreed to meet me yesterday to exchange the shower screen. I called upon arrival, he said he was 15 mins away. 45 mins later I called again, he said “just around the corner locking up, be there in a couple mins”. Another 40 mins later no show. Not answering my calls.
What can I do? I have kept a log of the emails I sent him confirming what we had discussed, the prices, what I ordered etc. I have no documents from him. So at this stage I have paid him $625 more than the price of what I’ve received, and 2 items of what I collected were not as described and ordered.
He stores his tiles at another location, and when I collected my first lot he asked me to go there and request what I needed from his supply. I am tempted to return to this location and request $625 worth of tiles and just store them for a future renovation project, so that at least I have some goods for my wasted money. But I would much prefer to have this dealt with properly, get my funds back, and issued with the invoice he said I could get.
Any advice would be gratefully appreciated.

If so you can complain to the office of fair trading…if not- then that’s the risk you take with private/Gumtree cheap sales
Nobody has the “authority” to do anything.. unless you sue…but given the amount it’s not worth it.Regards

Yes, he has an ABN and a registered business name.

I think you are missing the point… I knew the answer after reading a few words “who had a renovation business closing down”…. good luck ever getting anything out of him, office of fair trading won’t help you.
You are an unsecured creditor to an insolvent business.
Office of fair trading can see take him to court on your behalf- consumers right.
As long as he has a Active ABN + rego ( closing down, still can mean he has a active license) …fair trading can “legally” work their magic…Regards

ah let me add to that, he’s not closing down… he was exhibiting at the home show on the weekend and keeps taking on more work and purchasing more goods. i don’t see him leaving any time soon.
