    To cut a long story short, we purchased a block of land just under 6 acres through the local real estate. It is part of an estate so had convenants on what could be build on the land. We asked the real estate if there were any other plans and they contacted council to which the reply was no. Everything looked ok so we proceeded with the sale and the sale went throughfine, though solicitors as well.

    6 months later the block flooded twice and new fencing was ripped out from the water and debris. Since doing some  of our own research we came across a plan which was showing a buffer zone across most of our property. We were never made aware of this. The real estate did't know anything, the council didnt know anything & the solicitors didnt find it yet we found in on the net in the council minutes.

    Basically we are now told that our property is worthless……

    Where should we turn too now??? This is a good one!

    a proper search should have revealed some of these issues. The zoning certificate S149 would identify floodprone land – this forms part of the requirements for the sale of land in most states.

    Does the property have a creek, waterway etc? The DPI/council could confirm. Did you check?

    The agent can only disclose the information which has been provided to them.

    If you had a S149 and it doesn’t disclose floodprone land, there may be a case to answer.
