    Hi everyone,

My girlfriend and I have just bought 1 of 6 apartments on a block. We have been in there about 2 weeks.

The couple below us are making our lives terrible. They don't work, they just sit around all day and smoking. They scream at each-other hitting and kicking walls at all hours (weekend and week.) The person next to them is selling (not sure if its because of them but I think it is.) They have had a fight with him about something. They sit outsides his door smoking and talk to him, telling him they are glad he is moving out ect. Last night they were tapping on his window at 2:30am. they guy threatened his life and told him that nobody will buy his shit house. There is something every day.

I guess I should confront them but I know that if we start fighting with them the way they are fighting with the man down stairs my girlfriend will move out straight away, she is already scared of them.

We bought together and this is ment to be a happy time but it is turning out to be terrible.

    What I want to know is;

If they are renters can i get them kicked out?if so, how?

Can I do anything if they own (considering they dont work and seem like they never have i don't think they do)

The last option is to move out and rent out our appartment and rent somewhere else of the same value until they leave (after 6 months because we got the first home buys.) I would like advice on the financial side of this option aswell.

    Cheers,
    Shannon

Do you have a body corporate if so you should be able to find out from them if the unit is owner occupied or rented. If it is rented you should also be able to find out the Real estate agent then you can submit a complaint with them. I think thats all you can really do it is up to the agent/landlord whether they kick them out, if they are owners then I think there is less you can do.

If there is domestic violence going on call the Police. The new laws mean that even if the woman won't pursue it the cops can take it to court.

    Problems present opportunities.
It might mean you can buy either of the units cheap from a desperate seller.
You can guess what those tenants are like at paying rent.
If they are renters and the threatening type, complain strongly to the agent. If a tenant threatens a landlord, the Residential Tenancies Act in NSW takes it seriously and makes provision for termination of tenancy without notice.
BC should take action against bad behaviour.
Sounds like a situation that will not last long, use the opportunity.
    Good luck
    cheers
