    Help needed.

    I have recently inspected a property for sale in Victoria.  The real estate agent informed me the property was about to be listed and the section 32 was being developed.  I liked the property and therefore made an offer to purchase via a contract note, subject to a number of conditions, one of which was my solicitors approval of the section 32.

    I spoke to the real estate agent number of times and I had been informed that the offer was not made to the vendor.  The reason for this being that no section 32, no sale.  However, it is my understanding a contract note is binding if agree to by both parties.    

    Since then the real estate agent has not returned my calls and it's been a month since I was first informed about the property. 

    I'm at a lost as to my options and I would appreciate the advice and opinions of others.
