    Hi,

    I’m wondering if someone in the know help me get my head around this.

    I’m looking at buying a parcel of land in NSW. There are 4 blocks available on what was once a large square block. Lots 2 and 3 are at the back of the block and 1 and 4 are at the front. I have my eyes on one of the front blocks.

    My question is regarding the Right of Carriageway easement. (to the back blocks) I understand that all 4 blocks are equally burdened when it comes to repairs or whatever which is fine. There is an additional ‘Easement for Services’ of which is physically located UNDER the ‘Right of Carriageway’ easement. Where I am confused is that only Lots 1 and 4 are burdened with this easement however all lots are a benefit.
    Now, my interpretation of this is; For example, Lot 2’s telephone cable is stuffed and requires repair where the easement is. The burdened cost of this repair would be of Lot 1 and 4. Is this right?
    Is this the way these sort of easements are normally done or something to be cautious about?
