We are trying to set up a Discretionary trust where the Trustee is also a Beneficiary, is this possible and are their any pro’s and con’s of doing this, we have had some advice from our solicitor saying that it is not possible, would anyone have any relevant information on this or somewhere I can find out the correct procedure’s.
Any information would be much appreciated !
I have a trust where I am beneficiary and trustee, so do many of my clients. It is possible.
It may not be possible where the trustee is the only beneficary, but where they are one of many, it should be ok. Do some more research.
