A person i know, put down $100k (10%) deposit 2 years ago on a townhouse in a development. At the time, questions were asked of the Real Estate Agent (snake) about the vaugness of the drawings and finished projects appearance. (mainly in relation to be what appered to be some kind of wall, in front of the unit, blocking the veiw of the beach) Was told that this isn’t some 2 bit mob, but it was going to be a world class development etc and why would a wall be built in front of the unit and block out the selling point. Also questions were asked about windows etc and the same response was giving.
Lo and behold, developments completed and it has a wall in front of the unit so you can’t see the beach from downstairs and upstairs (sleepiong area) has a pokie little window.
The whoile purpose to buy at the beach was to be able to look at it, and be able to seel easily, not sit in a townhouse that really could be located anywhere.
was also put under extreme pressure to sign, told last unit, all the others were sold etc, people queing up to buy.
half way through (1 year into it), they release 5 units, that are light years ahead of this one ie: no wall blocking the view and they have balconies upstairs, for less then this person paid.
can anything be done?

hrb – Depends on where you are in relation to what can be done. Perhaps seeking legal advice would be an option. Generally speaking though if the agent has mis-represented the Property, you MAY (if I could underline that I would) have some recourse against them. Then again you could find yourself having to prove what was said. That may be an issue.
Definitely consult your Preferred Legal Counsel in relation to this though. They would be able to best advise you…

Mob: 0404 056 055Just an update, they lost the deposit and also another person they know lost $110K as well.
1 week after the deposits were taken, both properties were sold. Yet the agent couldn’t sell them for over 2 years of trying.
No wonder they end up dead.
