    Hi I am a first time landlord who after 12 months rental have decided to give the tenants 60 days notice to vacate as my new wife (wedding 25th Feb)and I will need to move in…..I have given the agency notice and now they have sent me a letter about a “HEARING”!!!!
    This looks like an application for a hearing by the RTA at a law courts. They wrtie on the letter thatit is the practice of their office to apply for a hearing as a matter of procedure to ensure the premisis become vacant at the time requested by the landlord…..Help m,e please understand what this means and what it will involve….anything wit hthe word COurt or law in it freaks me out.. Should I be concerned? Is this common practice when tenants are given notice to vacate?

    I am in Vic too and you have to give a tenant 4 mths notice to vacate (they only have to give you 2wks mind). You can give them 60 days notice if – there are reconstruction, repairs or renovations planned, the landlord or his family wants to move in. You are obviously going to do both of these aren’t you???. No way go to court, your PM and everyone else who can will charge you. I have never heard of going to court as a matter of course. I would go around to tenants and ask them if they have a problem with the vacate notice and take it from there.The PM works for you so just tell them no You can also ring Department of Justice – Consumer Affairs on 1300 55 81 81 and discuss all this with them and they will send you a free booklet with all this in. Don’t panic – you’re OK

    I just rang the Tenancy Advice line and they siad that the Hearing is just in case they dont move out on the prescribed day……then they can be “made” to move out….sounds like this is an insurance policy for us as landlords. They have been great tenants and I think they will leave in the prescribed time as they have already indicated they are looking around for a place anyway….Fingers crossed. Anyone have any experiences they can share or would liek to share with us????Please you are welcome…
